While framed as protecting "reproductive health care," this bill represents a dangerous overreach that threatens core constitutional rights, parental authority, evidence-based medicine, and the safety of New Jersey familiesβespecially our children.
Key Concerns:
Chilling Effect on Free Speech, Peaceful Assembly, and Religious Liberty: The billβs broad "interference" provisions could criminalize peaceful protest, video recording, information distribution, or expressive activities near facilitiesβeven within buffer zones. This risks turning concerned citizens, journalists, faith leaders, and advocates into criminals for exercising First Amendment rights. Such restrictions echo laws struck down or narrowed by courts for unconstitutional overbreadth. New Jersey taxpayers should not fund inevitable legal challenges.
Shielding Harmful Gender-Affirming Interventions on Minors: By protecting providers of gender-affirming careβincluding puberty blockers, cross-sex hormones, and surgeries for minorsβfrom out-of-state accountability and professional scrutiny, the bill prioritizes ideology over science and child safety. The Cass Review (UK), Finnish studies, and other evidence show weak evidence for benefits, significant risks of harm (including worsened mental health, infertility, and lifelong medical dependency), and the need for extreme caution with minors. New Jersey should not create a "sanctuary" for experimental practices rejected by a growing medical consensus in Europe.
Undermining Parental Rights and Interstate Cooperation: The bill creates barriers to legitimate inquiries from other states in custody disputes or cases involving runaway minors. It erodes parental notification and consentβfundamental rightsβwhile limiting transparency and accountability for controversial procedures.
Violates Constitutional Principles and Evidence-Based Policy: This legislation elevates certain interests while suppressing dissent, parental authority, and public oversight. It does not balance rights; it silences opposition to practices lacking robust scientific support. True "Do No Harm" healthcare protects the vulnerable, upholds free speech, and respects the natural family as the foundation of society (Matthew 19:4-6).
