Parental Consent has Changed with SCOTUS Decision. Mahmoud v. Taylor

Parents Win Key Supreme Court Test in Mahmoud v. Taylor - Education Next

Parents have a fundamental role in directing the upbringing and education of their children — and recent legal developments are reinforcing that principle.

The decision in Mahmoud v. Taylor is widely viewed by constitutional attorneys as a strong affirmation that parental rights and religious liberty must be respected in the public school setting. While schools have authority over curriculum, parents retain protected rights when instructional materials conflict with sincerely held beliefs.

That’s why our friends at Liberty Counsel have developed a new Parental Opt-Out Form to help families clearly and respectfully assert their rights with local schools.

What this means for parents

  • Parents have a recognized role in guiding their children’s moral and religious formation.

  • Schools should provide transparency and reasonable accommodations when materials conflict with family beliefs.

  • Families can take proactive steps to communicate concerns and request alternatives.

New Resource: Parental Opt-Out Form

This ready-to-use form is designed to help parents:

✔ Communicate clearly with school administrators
✔ Request notice and alternative assignments when needed
✔ Document concerns in a respectful, professional way

We encourage every parent to review this resource — even if you have not yet encountered a problem — so you are prepared and informed.

Take Action Today

If you believe parental rights deserve strong protection in our schools, take a moment to:

➡️ Download and review the Parental Opt-Out Form on human sexuality.
➡️ Share this resource with other parents in your community
➡️ Stay engaged with ongoing policy issues affecting families

➡️Make sure you send a copy of your opt-out form to every teacher your student child has. Send a copy to the school district superintendent, principal, and to your local School Board of Education. You may need to repeat this every semester and certainly every new school year.

At the Center for Garden State Families, we believe parents — not government institutions — are the primary educators and moral guides of their children. We will continue working to ensure policies respect families, faith, and constitutional freedoms.

Thank you for standing with us for strong families and parental rights.

Sincerely,
Center for Garden State Families
