State of New Jersey vs Middletown BOE, et al. Recent State Appellate Case Legal Analysis

The Center for Garden State Families commissioned a legal analysis on the case of  'State of NJ vs. Middletown BOE, et al'. 

Both sides of the issue are claiming victory, and this becomes very confusing. 

Three school districts in Monmouth County – Middletown, Marlboro and, Manalapan-Englishtown – amended a state policy to require parental notification regarding transgender students. 

In a nutshell, according to our prepared legal analysis, parents and educational freedom did not win!

However, local school boards can continue to resend policy 5756. Policy 5756 according to the assistant state Atty. Gen. said in court that policy 5756 is not a required mandate for local school districts in response to a question by the judge. The Center for Garden State Families strongly urges you to become involved in your child's education both as a parent and as a taxpayer. You are a stakeholder in the public education that you pay for. Urge your local school board of education to remove policy 5756.

Policy 5756 was designed to protect the now-debunked transgender ideology and keep secrets from parents about their own children's behavior regarding transgenderism. 

The policy states in part: “The school district shall accept a student’s asserted gender identity; parental consent is not required. . . . There is no affirmative duty for any school district staff member to notify a student’s parents of the student’s gender identity or expression. . . . And should continue to refer to the student in accordance with the student's chosen name and pronoun at school....”  You can see our full policy by clicking here.
